Divorce Formal procedures
We will calculate your share of the vested pension benefits (retirement benefits) during the marriage and send you written confirmation of the amount. Please tell us the anticipated date of your divorce as well as the date of your marriage.

A statement of practicability will be made out for the attention of the court unless the entitlement to benefit is due to mature by the date of the divorce.

After we have received the decree absolute - directly from the court - we will transfer the amount set out in the decree absolute to the divorced spouse as instructed.

The same procedure applies in the case of an annulment of a registered partnership.

Implications of divorce
The payout of some of the retirement benefits acquired during the marriage will reduce the existing retirement assets and therefore the future old-age benefits. 

The amount paid out following a divorce can be repurchased by the insured person at any time without any formalities (unlike the purchase of individual contributions).

Divorce in another country
A Swiss pension fund is not subject to foreign jurisdiction. 

If the divorce proceedings were executed in another country then there is no automatic entitlement to a share of the vested pension benefits (retirement benefits) being paid to the ex-spouse. 

A foreign divorce decree with reference to the settlement of the occupational pension under Swiss law must be recognised by a Swiss court. If the Swiss court acknowledges the decree, a payment can be made in settlement of the case.
